A parenting plan is a written agreement between two people after they’ve gone to mediation. It outlines the future care arrangements for a child or children of the relationship, and both parties sign it. Parenting plans aren’t legally binding and can’t be enforced by a court. Even if a court considers these documents, they’re often not properly drafted and can’t be enforced.
In parenting matters, orders contain similar provisions to parenting plans, but they’re drafted so that they can be enforced by court if that’s the case. Unlike a parenting plan, an Order made by the court is legally binding and enforceable.
A family relationships center can help parents make a parenting plan that reflects their future parenting arrangements. They take the document to a family lawyer, who can then draft it in a way that the court will accept, and make orders based on it. Most lawyers can include most of the information from a parenting plan in a Minute of Order, but there are some things that can’t be included in parenting consent orders. When one party decides they won’t follow the parenting plan, it can’t be relied on, but a court order has to be followed, and changing circumstances don’t let one party change the terms of the order or refuse to follow it unless both parties agree.
